General Terms and Conditions (GTC) of the career counseling contract*

Preamble

The Contractor is a provider of career counseling services, which are aimed in
particular at persons from outside the EU who need support in finding professional
opportunities within the EU. These services include consulting, training, and
preparation of individual application documents as well as the implementation of tests
and training. This agreement sets forth the basic terms and conditions for the
performance of these counseling services.


The counseling services serve to support the customer and are not a guarantee of
success. The contracting parties agree that this agreement is not legal advice.


1. Subject of the contract


(1) The Contractor shall provide the Client with counseling services ("services"). The
service is provided on the basis of a service contract within the meaning of §§ 611
ff. German Civil Code (BGB). Services under a contract for work and services are
not the subject of this contract. The Contractor owes no legal success beyond the
provision of the services.
(2) The scope of the services is set out in the concrete offer and these general terms
and conditions (GTC). If there are any inconsistencies or conflicts between the offer
and these GTCs, the offer shall prevail, unless it is specified which provision of the
offer should be deviated from.
(3) The Client's general terms and conditions of business or delivery shall not apply.
This also applies if the Client's terms and conditions are not expressly contradicted.
(4) These GTCs also apply to all future business relationships between the Contractor
and the Client, without the need for a renewed explicit inclusion, provided that the
current version of the GTC has been made known to the Client beforehand or is
accessible.


2. Service provision by the Contractor


(1) The services are provided by the Contractor after prior consultation with the
customer at the specified times. Any changes or adjustments to the agreed times
must be communicated in advance and by agreement between the parties.
Feedback on individual appointment requests is usually provided within two weeks.
(2) The Contractor shall generally provide the services at a location of their choice.
Unless otherwise agreed, the services are provided on the Contractor's premises
or via digital communication channels (e.g., video conferences, online platforms).
(3) If the service is provided at a location requested by the Client, this requires a
separate written agreement. Any additional costs, such as travel and
accommodation costs, are charged separately and are to be borne by the Client.
(4) Unless a separate installment payment agreement is in place, the provision of
services will begin only after the Contractor has received at least 70 percent of the
agreed amount specified in the offer.


3. Remuneration


(1) The remuneration agreed in the offer applies.
If no specific remuneration is agreed upon in the offer or if the contract is terminated
early, the services will be charged according to the following terms:
EUR 250.00 per hour (for both preparatory and counseling activities).
(2) A full day of consultation consists of an average of eight hours. Consultation days
provided to a lesser or greater extent will be billed on a pro-rata hourly basis.
The preparation of consulting material is included in the remuneration. They will
only be remunerated additionally if this is expressly agreed in the individual order.
All prices are exclusive of statutory VAT.
The remuneration is due for payment within 30 days after receipt of the invoice. In
the event of a delay, the statutory provisions shall apply.


4. Obligations to cooperate and intellectual property


(1) The Contractor shall provide the Client with all documents necessary for the
performance of their services.
(2) The Contractor remains the owner of all materials protected by industrial property
rights or similar rights of any kind (such as patent rights, trademark rights, utility
model and design rights, copyright), whether registered or not ("intellectual property
rights"), that are or can be protected ("materials") and that belong to the Contractor
at the time of concluding this contract or are developed by the Contractor (or by
third parties on their behalf) after the conclusion of this contract ("Contractor
materials"). The same applies to the processing, modification and further
development of Contractor materials.
(3) Upon the delivery of the Contractor materials to the Client, the Contractor grants
the Client a simple, non-exclusive, unlimited, non-transferable right of use, insofar
as this is necessary for the purpose of the contract.
(4) The Client is not entitled to alter, edit, reproduce, publish, or otherwise distribute or
use the Contractor materials without prior written consent from the Contractor.
(5) The Contractor is not responsible for any third-party rights that may hinder, restrict,
or exclude the Client's contractual use of the materials provided by the Contractor
under this contract. Client claims due to an infringement of third-party property
rights are excluded. This does not apply in cases of intent, gross negligence, or
breach of a fundamental obligation whose fulfillment is essential for the proper
performance of the contract and on which the Client could rely, as well as in cases
of injury to the body, health, or life.
(6) In the event of claims being made by third parties against the Client, the Client shall
not acknowledge the third party's claims without the written consent of the
Contractor.
(7) The Client must promptly inform the Contractor if they have professional experience
in the automotive industry or if they plan to apply for a job in the automotive industry
after the completion of this contract.


5. Entry into force and termination


(1) The contract shall take effect when signed by both parties.
(2) The contractual relationship ends upon the achievement of its purpose. The
purpose is achieved when the agreed services have been provided and the
required documents have been handed over. Ordinary termination of the
contractual relationship shall be excluded.
(3) If the contractual relationship is terminated early, the Contractor is entitled to
compensation for the services and expenses provided up to the effective date of
termination. If the parties have agreed on a fixed price, the services provided by
the Contractor up to the effective date of termination will be billed based on the
agreed daily or hourly rates, according to the work involved.
(4) The right to terminate for good cause shall remain unaffected. A good cause exists
in particular if
a) the Client fails to make payments due within a reasonable period despite a
reminder or if the client repeatedly defaults on payment.
b) the Client fails to fulfill their contractual cooperation obligations despite a written
request and the setting of a reasonable grace period, and this significantly
impairs the provision of services.
c) the Client becomes insolvent, an application is made to open insolvency
proceedings against the Client's assets or insolvency proceedings have been
opened. This also applies if such a request is rejected due to insufficient assets
or if other circumstances arise that suggest a sustained deterioration in the
Client's financial situation.
d) the Client breaches the agreed confidentiality or non-disclosure obligation, or
violates the provision regarding usage rights, thereby significantly jeopardizing
the Contractor's interests.
(5) the Client has professional experience of less than three years and intends to apply
in the automotive industry, the Contractor has an extraordinary right of termination.
(6) Notice of termination must be given in writing (e.g. by e-mail).


6. Limitation of liability


(1) Within the framework of the statutory provisions, the Contractor shall be liable
without limitation for damage resulting from injury to life, limb or health, which is
due to intent or negligence on their part or that of their legal representatives or
vicarious agents.
(2) For other damages, the Contractor is liable under the statutory provisions only as
follows: The Contractor is fully liable for damages resulting from intent or gross
negligence on their part, or that of their legal representatives or vicarious agents,
as well as for damages that fall within the scope of a guarantee or assurance
provided by them.
(3) The above provisions shall also apply mutatis mutandis to the Contractor's liability
with regard to the reimbursement of wasted expenses.
(4) This does not affect the liability of the Contractor under the German Product Liability
Act (Produkthaftungsgesetz).


7. Data protection


The parties will comply with the relevant provisions, in particular those of the General
Data Protection Regulation (GDPR), when handling personal data. The parties will not
process personal data without authorization in connection with the establishment,
implementation and termination of this contract (data secrecy). They will impose the
same obligations on individuals they involve in the establishment, execution, and
termination of this contract. Data confidentiality continues to apply even after duties
have ceased.


8. Confidentiality, storage, and return of documents


(1) The parties agree to treat confidential information disclosed in the context of or prior
to the cooperation as strictly confidential and not to disclose or use this information
to third parties, unless this is necessary for the performance of the contract.
(2) Confidential personal or business documents that the Contractor receives as part
of the cooperation must be stored carefully and protected against inspection by
third parties. Upon termination of the contract, the documents must be returned to
the Client or deleted in accordance with the principles of the GDPR.
(3) This obligation of confidentiality also applies beyond the term of this contract.


9. Cancellation of appointments and no-shows


(1) The client is obliged to cancel agreed consultation appointments in writing or in text
form (e.g. by e-mail) at least 72 hours before the planned start.
(2) If the cancellation is not made in due time or if the client does not show up for the
agreed appointment without canceling (no-show), the contractor is entitled to
demand a contractual penalty in the amount of the agreed remuneration for the
canceled or unattended appointment. This contractual penalty shall amount to one
full consulting unit (at least one hour).
(3) The Client reserves the right to prove that the Contractor has incurred no or
significantly less damage. The Contractor reserves the right to assert further claims
for damages.
(4) Should the Contractor have to cancel the appointment due to unforeseen
circumstances, it shall propose an alternative date to the Client as soon as possible.


10. Closing provisions


(1) The exclusive place of jurisdiction for both parties is the registered office of the
Contractor, insofar as the Client is not a consumer or does not operate a
commercial business. If the Client is a consumer and does not have a general place
of jurisdiction in Germany, the place of jurisdiction is the registered office of the
Contractor.
(2) German law shall apply exclusively to the exclusion of all legal norms that refer to
another legal system; the application of the UN Convention on Contracts for the
International Sale of Goods is excluded.
(3) The Client may only offset the Contractor's claims for compensation with
undisputed or legally established claims. The Client may only assert a right of
retention with undisputed or legally established claims.
(4) If any provision of the contract or the General Terms and Conditions is or becomes
incomplete or ineffective, the validity of the contract and the remaining provisions
will not be affected. Such a provision is then deemed to be agreed upon, which
comes as close as possible to the expressed intention of the contract.

Allgemeine Geschäftsbedingungen (AGB) zum Karriereberatungsvertrag


Präambel


Der Auftragnehmer ist ein Anbieter von Karriereberatungsdienstleistungen, die sich
insbesondere an Personen aus dem EU-Ausland richten, die Unterstützung bei der
Suche nach beruflichen Möglichkeiten in der EU benötigen. Diese Dienstleistungen
umfassen Beratung, Schulungen, Erstellung individueller Bewerbungsunterlagen
sowie die Durchführung von Tests und Trainings. Die vorliegende Vereinbarung regelt
die grundlegenden Bedingungen für die Durchführung dieser Beratungsdienstleistungen.


Die Beratungsleistungen dienen der Unterstützung des Kunden und stellen kein
Erfolgsgarantieversprechen dar. Die Vertragsparteien sind sich einig, dass es sich bei
dieser Vereinbarung nicht um eine Rechtsberatung handelt.


1. Vertragsgegenstand
(1) Der Auftragnehmer erbringt für den Auftraggeber Beratungsleistungen
(„Leistungen“). Die Leistungserbringung erfolgt auf dienstvertraglicher Basis im
Sinne der §§ 611 ff. BGB. Werkvertragliche Leistungen sind nicht Gegenstand
dieses Vertrags. Der Auftragnehmer schuldet über die Erbringung der Leistungen
hinaus keinen rechtlichen Erfolg.
(2) Der Umfang der Leistungen ergibt sich aus dem konkreten Angebot und diesen
allgemeinen Geschäftsbedingungen (AGB). Im Fall von Unklarheiten und
Widersprüchen zwischen dem Angebot und diesen AGB geht das Angebot vor, es
sei denn, es wurde bestimmt, dass und von welcher Regelung des Angebots
abgewichen werden soll.
(3) Die Allgemeinen Geschäfts- oder Lieferbedingungen des Auftraggebers finden
keine Anwendung. Dies gilt auch dann, wenn den AGB des Auftraggebers nicht
ausdrücklich widersprochen wird.
(4) Diese AGB gelten auch für alle zukünftigen Geschäftsbeziehungen zwischen dem
Auftragnehmer und dem Auftraggeber, ohne dass es einer erneuten
ausdrücklichen Einbeziehung bedarf, sofern die jeweils aktuelle Fassung der AGB
dem Auftraggeber zuvor bekannt gemacht wurde oder zugänglich ist.


2. Leistungserbringung des Auftragnehmers


(1) Die Leistungen werden vom Auftragnehmer nach vorheriger Absprache mit dem
Kunden zu den festgelegten Zeiten erbracht. Änderungen oder Anpassungen der
vereinbarten Zeiten bedürfen einer rechtzeitigen Mitteilung und Abstimmung
zwischen den Parteien. Eine Rückmeldung zu individuellen Terminanfragen erfolgt
in der Regel innerhalb von zwei Wochen.
(2) Der Auftragnehmer erbringt die Leistungen grundsätzlich an einem von ihm frei
wählbaren Ort. Soweit nicht anders vereinbart, erfolgen die Dienstleistungen in den
Räumen des Auftragnehmers oder über digitale Kommunikationswege (z. B.
Videokonferenzen, Online-Plattformen).
(3) Sollte die Leistungserbringung an einem vom Kunden gewünschten Ort erfolgen,
bedarf dies einer gesonderten schriftlichen Vereinbarung. Eventuell anfallende
zusätzliche Kosten, wie beispielsweise Reise- und Übernachtungskosten, werden
gesondert berechnet und sind vom Kunden zu tragen.
(4) Soweit keine gesonderte Ratenzahlungsvereinbarung vorliegt, beginnt die
Leistungserbringung erst nach Zahlungseingang von mindestens 70 Prozent des
im Angebot vereinbarten Betrages beim Auftragnehmer.


3. Vergütung

(1) Es gilt die im Angebot vereinbarte Vergütung.
Ist im Angebot keine konkrete Vergütung vereinbart oder sollte der Vertrag vorzeitig
beendet werden, werden die Dienstleistungen zu den nachfolgenden Konditionen
berechnet:
EUR 250,00 je Stunde (sowohl für vorbereitende, als auch für beratende
Tätigkeiten).
(2) Der voller Beratungstag umfasst durchschnittlich acht Stunden. Beratungstage, die
in geringerem oder höherem Umfang erbracht werden, werden anteilig auf
Stundenbasis abgerechnet.
Die Erstellung von Beratungsmaterial sind in der Vergütung inbegriffen. Sie werden nur dann zusätzlich vergütet, wenn dies im Einzelauftrag ausdrücklich vereinbart ist.
Sämtliche Preise verstehen sich zzgl. gesetzlicher Umsatzsteuer.
Die Vergütung ist nach Zugang der Rechnung innerhalb von 30 Tagen zur Zahlung
fällig. Im Falle des Verzugs gelten die gesetzlichen Bestimmungen.


4. Mitwirkungspflichten und geistiges Eigentum


(8) Der Auftragnehmer stellt dem Auftraggeber alle für die Durchführung seiner
Leistungen erforderlichen Unterlagen zur Verfügung.
(9) Der Auftragnehmer bleibt Inhaber aller Materialien, die durch gewerbliche
Schutzrechte oder schutzrechtsähnliche Positionen gleich welcher Art (zum
Beispiel Patentrechte, Markenrechte, Gebrauchs- und Geschmacksmusterrechte,
Urheberrechte) und gleich ob eingetragen oder nicht („geistige Eigentumsrechte“),
geschützt sind oder geschützt werden können („Materialien“) und ihm zum
Zeitpunkt des Abschlusses dieses Vertrags zustehen oder von ihm (oder von
Dritten in seinem Auftrag) nach Abschluss dieses Vertrags entwickelt werden
(„Auftragnehmer-Materialien“). Entsprechendes gilt für Bearbeitungen,
Änderungen und Weiterentwicklungen von Auftragnehmer-Materialien.
(10) Mit der Übergabe der Auftragnehmer-Materialien an den Auftraggeber räumt
der Auftragnehmer dem Auftraggeber hieran ein einfaches, nicht-ausschließliches,
zeitlich unbeschränktes, nicht übertragbares Nutzungsrecht ein, soweit sich dies
aus dem Zweck des Vertrags ergibt.
(11) Der Auftraggeber ist nicht berechtigt, die Auftragnehmer-Material ohne
vorherige schriftliche Zustimmung des Auftragnehmers zu verändern, zu
bearbeiten, zu vervielfältigen, zu veröffentlichen oder anderweitig verbreiten oder
zu nutzen.
(12) Der Auftragnehmer trägt nicht die Verantwortung dafür, dass keine Rechte
Dritter bestehen, welche die vertragsgemäße Nutzung der vom Auftragnehmer
unter diesem Vertrag gelieferten Materialien durch den Auftraggeber behindern,
einschränken oder ausschließen. Ansprüche des Auftraggebers wegen einer
Verletzung von Schutzrechten Dritter sind ausgeschlossen. Dies gilt nicht im Fall
von Vorsatz, grober Fahrlässigkeit, Verletzung einer wesentlichen Pflicht, deren
Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst
ermöglicht und auf deren Einhaltung der Auftraggeber vertrauen durfte sowie bei
der Verletzung des Körpers, der Gesundheit, des Lebens.
(13) Im Fall der Geltendmachung von Ansprüchen durch Dritte gegenüber dem
Auftraggeber, wird der Auftraggeber Ansprüche des Dritten nicht ohne schriftliche
Zustimmung des Auftragnehmers anerkennen.
(14) Der Auftraggeber hat dem Auftragnehmer unverzüglich mitzuteilen, wenn er
über Berufserfahrung in der Automobilbranche verfügt oder wenn er plant sich nach
der Durchführung dieses Vertrages in der Automobilbranche zu bewerben.


5. Inkrafttreten und Kündigung


(7) Der Vertrag tritt mit Unterzeichnung durch beide Vertragsparteien in Kraft.
(8) Das Vertragsverhältnis endet mit Zweckerreichung. Der Zweck ist erreicht, wenn
die vereinbarten Leistungen erbracht und die erforderlichen Unterlagen übergeben
wurden. Eine ordentliche Kündigung des Vertragsverhältnisses ist
ausgeschlossen.
(9) Sollte das Vertragsverhältnis dennoch vorzeitig beendet werden, hat der
Auftragnehmer einen Anspruch auf Vergütung der bis zum Wirksamwerden der
Kündigung erbrachten Leistungen und Aufwendungen. Soweit die Vertragsparteien
einen Festpreis vereinbart haben, werden die bis zur Wirksamkeit der Kündigung
vom Auftragnehmer erbrachten Leistungen nach Aufwand unter Zugrundelegung
vereinbarten Personentagessätze oder Stundensätze abgerechnet.
(10) Das Recht zur Kündigung aus wichtigem Grund bleibt unberührt. Ein wichtiger
Grund liegt insbesondere vor, wenn
e) der Auftraggeber trotz Mahnung fällige Zahlungen nicht innerhalb einer
angemessenen Frist nachzahlt oder wenn der Auftraggeber wiederholt in
Zahlungsverzug gerät.
f) der Auftraggeber seine vertraglich vereinbarten Mitwirkungspflichten trotz
schriftlicher Aufforderung und Setzung einer angemessenen Nachfrist nicht
erfüllt und dadurch die Leistungserbringung erheblich beeinträchtigt wird.
g) der Auftraggeber zahlungsunfähig wird, ein Antrag auf Eröffnung eines
Insolvenzverfahrens über das Vermögen des Auftraggebers gestellt wird oder
das Insolvenzverfahren eröffnet wurde. Dies gilt auch, wenn ein solcher Antrag
mangels Masse abgelehnt wird oder andere Umstände bekannt werden, die auf
eine nachhaltige Verschlechterung der Vermögensverhältnisse des
Auftraggebers schließen lassen.
h) der Auftraggeber gegen die vereinbarte Verschwiegenheits- oder
Vertraulichkeitspflicht verstößt oder die Regelung über die Nutzungsrechte und
dadurch die Interessen des Auftragnehmers erheblich gefährdet werden.
(11) Hat der Auftraggeber Berufserfahrung von unter drei Jahren und die Absicht
sich in der Automobilbranche zu bewerben, steht dem Auftragnehmer ein
außerordentliches Kündigungsrecht zu.
(12) Kündigungen bedürfen der Textform (z. B. per E-Mail).


6. Haftungsbeschränkung

(5) Der Auftragnehmer haftet im Rahmen der gesetzlichen Bestimmungen
unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der
Gesundheit, die auf Vorsatz oder Fahrlässigkeit seinerseits oder seiner
gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.
(6) Für sonstige Schäden haftet der Auftragnehmer im Rahmen der gesetzlichen
Bestimmungen nur wie folgt: Der Auftragnehmer haftet dem anderen unbeschränkt
für Schäden, die auf Vorsatz oder grober Fahrlässigkeit seinerseits oder eines
seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen, sowie für Schäden,
die in den Schutzbereich einer von ihm gegebenen Garantie oder Zusicherung
fallen.
(7) Die vorstehenden Bestimmungen gelten sinngemäß auch für die Haftung des
Auftragnehmers im Hinblick auf den Ersatz vergeblicher Aufwendungen.
(8) Die Haftung des Auftragnehmers nach dem Produkthaftungsgesetz bleibt
unberührt.


7. Datenschutz


Die Vertragsparteien werden beim Umgang mit personenbezogenen Daten die jeweils
einschlägigen Bestimmungen, insbesondere die der Datenschutz-Grundverordnung
(DSGVO), einhalten. Die Vertragsparteien werden im Zusammenhang mit der
Begründung, Durchführung und Beendigung dieses Vertrags personenbezogene
Daten nicht unbefugt verarbeiten (Datengeheimnis). Sie werden Personen, die sie im
Zusammenhang mit der Begründung, Durchführung und Beendigung dieses Vertrags
einsetzen, entsprechend verpflichten. Das Datengeheimnis besteht auch nach
Beendigung ihrer Tätigkeit fort.


8. Verschwiegenheit, Aufbewahrung und Rückgabe von Unterlagen


(4) Die Parteien vereinbaren, vertrauliche Informationen, die im Rahmen oder Vorfeld
der Zusammenarbeit offengelegt werden, als streng vertraulich zu behandeln und
diese Informationen nicht an Dritte weiterzugeben oder zu verwenden, es sei denn,
dies ist zur Durchführung der Vertragserfüllung erforderlich.
(5) Vertrauliche persönliche oder geschäftliche Unterlagen, die der Auftragnehmer im
Rahmen der Zusammenarbeit erhält, sind von ihm sorgfältig und gegen die
Einsichtnahme Dritter geschützt aufzubewahren. Nach Beendigung des Vertrages
sind die Unterlagen an den Auftraggeber zurückzugeben beziehungsweise im
Einklang mit den Grundsätzen der DSGVO zu löschen.
(6) Diese Verpflichtung zur Vertraulichkeit gilt auch über die Laufzeit dieses Vertrags
hinaus.


9. Terminabsagen und Nichterscheinen


(1) Der Auftraggeber ist verpflichtet, vereinbarte Beratungstermine spätestens 72
Stunden vor dem geplanten Beginn schriftlich oder in Textform (z. B. per E-Mail)
abzusagen.
(2) Erfolgt die Absage nicht fristgerecht oder erscheint der Auftraggeber ohne Absage
nicht zum vereinbarten Termin (No-Show), ist der Auftragnehmer berechtigt, eine
Vertragsstrafe in Höhe der für den abgesagten oder nicht wahrgenommenen
Termin vereinbarten Vergütung zu verlangen. Diese Vertragsstrafe beträgt eine
volle Beratungseinheit (mindestens eine Stunde).
(3) Dem Auftraggeber bleibt der Nachweis vorbehalten, dass dem Auftragnehmer kein
oder ein wesentlich geringerer Schaden entstanden ist. Die Geltendmachung eines
weitergehenden Schadensersatzanspruchs bleibt dem Auftragnehmer
vorbehalten.
(4) Sollte der Auftragnehmer den Termin aufgrund unvorhergesehener Umstände
absagen müssen, wird er dem Auftraggeber schnellstmöglich einen Ersatztermin
vorschlagen.


10. Abschließendes


(1) Ausschließlicher Gerichtsstand ist für beide Vertragspartner der Sitz des
Auftragnehmers, soweit der Auftraggeber kein Verbraucher ist oder kein
Handelsgewerbe betreibt. Ist der Auftraggeber Verbraucher und hat keinen
inländischen allgemeinen Gerichtsstand, ist der Gerichtsstand der Sitz des
Auftragnehmers.
(2) Es gilt ausschließlich deutsches Recht unter Ausschluss aller Rechtsnormen, die
in eine andere Rechtsordnung verweisen; die Anwendung des UNÜbereinkommens
über Verträge über den internationalen Warenverkauf ist
ausgeschlossen.
(3) Gegen Vergütungsansprüche des Auftragnehmers kann der Auftraggeber nur mit
unbestrittenen oder rechtskräftig festgestellten Forderungen aufrechnen. Ein
Zurückbehaltungsrecht kann der Auftraggeber nur mit unbestrittenen oder
rechtskräftig festgestellten Forderungen geltend machen.
(4) Sollte eine Bestimmung des Vertrages oder der Allgemeinen
Geschäftsbedingungen lückenhaft oder unwirksam sein oder werden, so wird die
Wirksamkeit des Vertrages und der übrigen Bestimmungen dadurch nicht berührt.

1. Access data / Server log files
When visiting our website, the servers of our website host automatically store the information sent by your browser, so-called server log files.

The information includes the following:

•       Referrer (previously visited webpage)

•       Requested webpage or file

•       Browser type and browser version

•       Operating system used

•       Amount of data transmitted

•       Device type used

•       Time of access

•       IP address in anonymized form (e.g., by shortening the last digits so that no conclusions about individuals are possible)

The temporary processing of this data by the system is necessary to enable delivery of the website to your end device. For this purpose, the IP address must be processed in particular. No combination of this data with other data sources takes place. The information is used exclusively to control our own website traffic and to maintain the technical operation of the servers and network of our host as well as abuse prevention. The data is automatically deleted after 7 days. The legal basis is Article 6 paragraph 1 subparagraph 1 letter f GDPR.

2. Cookies
Our website uses exclusively technically necessary cookies to provide the basic functions of the website. Other technologies such as Local Storage or similar storage techniques are not used unless this is expressly mentioned below. Furthermore, we only use functional cookies so that we can provide you with the accessed website along with functions, § 25 paragraph 2 number 2 Telecommunications-Digital-Services-Data Protection Act (TDDDG), Article 6 paragraph 1 subparagraph 1 letter f GDPR.

Insofar as you give consent for optional services, non-required cookies, the legal basis is § 25 paragraph 1 TDDDG, Article 6 paragraph 1 subparagraph 1 letter a GDPR (consent). The legal basis is Article 6 paragraph 1 subparagraph 1 letter b GDPR and/or in case of consent Article 6 paragraph 1 subparagraph 1 letter a GDPR.

4. Integration of third-party services and content
It may occur that content and services from third parties from other websites are integrated or loaded within our online offering. This always presupposes that the providers of this content perceive the IP address of users. Because without the IP address, they could not send the content to the browser of the respective user. The IP address is thus required for the presentation of this content. We strive to use only content whose respective providers use the IP address solely for the delivery of content. Third-party providers may store the IP address, e.g., for statistical purposes.

To manage your potential consents, we use a consent management tool.

The consent management tool is hosted on our own servers, so no data is transmitted directly to external servers. The processing of data collected by the tool (e.g., your consent decisions) occurs exclusively locally on our systems.

The legal basis is our legitimate interest in consent management capability, Article 6 paragraph 1 subparagraph 1 letter f GDPR; furthermore, in case of your consent Article 6 paragraph 1 subparagraph 1 letter a GDPR. In addition, we may be legally obligated to obtain consents and their verifiability, cf. Article 6 paragraph 1 subparagraph 1 letter c GDPR as well as respectively GDPR and/or TDDDG, cf. above.

JavaScript Libraries

We use the following JavaScript libraries to improve the functionality and user-friendliness of our website:

reCAPTCHA

We use Google's "reCAPTCHA" service to detect and prevent bots and spam messages. Google refers to Google LLC., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA and Google-affiliated companies. For users who have their habitual residence in the European Economic Area or Switzerland, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, EU is the responsible controller for Google services. Google Ireland Limited is therefore the Google LLC-affiliated company whose services are integrated and which must also comply with GDPR.

In this process, the following data is processed: already installed Google cookies, previous browser interactions, number of mouse movements and keystrokes, dwell time on websites, IP address of the website visitor, date, screenshot of the browser window, referrer URL (the address of the page the visitor comes from), browser plugins, information about the operating system (Windows, Linux, iOS), user device settings (e.g., language settings, location, browser, etc.).

Fonts

We use Google Fonts API (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) for displaying attractive fonts. In this process, data such as your IP address, User-Agent and information about the requested fonts are transmitted to the providers to deliver the fonts. Data transmission to the USA (Font Awesome) is based on the EU-US Data Privacy Framework (https://www.dataprivacyframework.gov) as well as standard contractual clauses. The legal basis is Article 6 paragraph 1 subparagraph 1 letter f GDPR (legitimate interest in a uniform and attractive presentation of the website). To reduce bandwidth usage and increase network performance for the end user, we use gstatic, APIs from Google, see above. This is a domain used by Google to outsource static content to another domain name. Through this, the following is processed: images, CSS. CSS, Cascading Style Sheets is a stylesheet language for electronic documents and together with HTML and JavaScript one of the core languages of the World Wide Web.

The legal basis is Article 6 paragraph 1 subparagraph 1 letter a GDPR (consent).

Data transmission to the USA is based on an adequacy decision as well as subsequently on the standard contractual clauses of the European Commission. YouTube

On our website, we embed videos from YouTube or link to them, a platform of Google (see above). When you visit a page with an embedded YouTube video, after your consent for this, a connection is established to YouTube's servers. In this process, data such as your IP address, information about your device, the visited website and the time of access are transmitted to YouTube. If you are logged into Google, this usage can be attributed to your Google account. YouTube also uses cookies or similar technologies to analyze user behavior and display personalized advertising.

The embedding of YouTube videos is based on your consent according to Article 6 paragraph 1 subparagraph 1 letter a GDPR, which you can grant via our consent management tool. Without your consent, the videos are not loaded and no data transmission to YouTube occurs.

Furthermore, you leave our website when linking to a video.

The collected data may be transferred to Google servers in the USA and processed there. Google ensures an adequate level of data protection through the use of standard contractual clauses and there is a so-called adequacy decision under which Google self-certifies.

You can prevent data transmission to YouTube by revoking your consent in the consent management tool, blocking cookies in your browser or logging out of your Google account before visiting our website.

Newsletter

When registering to receive our newsletter, the data you provide is used exclusively for this purpose of sending the newsletter to you. It is sufficient to provide an email address for this. The data is used exclusively for newsletter delivery and is not shared with third parties. We use our data processor BREVO, Sendinblue GmbH, Köpenikcker Str. 126, 10179 Berlin, https://www.brevo.com/de/. The legal basis for sending is, in case of consent, Article 6 paragraph 1 subparagraph 1 letter a, Article 7 GDPR; otherwise Article 6 paragraph 1 subparagraph 1 letter f GDPR in connection with § 7 paragraph 3 UWG.

After online registration, you will receive an email asking you to confirm your registration. The background is to prevent misuse of your email address by third parties. The newsletter registration is logged to be able to prove the registration process according to legal requirements. This includes storing the email address, IP address, registration time and confirmation time. The legal basis for this is Article 6 paragraph 1 subparagraph 1 letters f and c GDPR.

Our newsletters contain information about offers as well as news about us. If the newsletter content is specifically described when registering for the newsletter, this is decisive for your consent to receive the newsletter. You can revoke your consent to the processing of personal data and its use for newsletter delivery at any time. Each newsletter contains a corresponding link for this purpose. According to Article 7 paragraph 3 GDPR, you can revoke your once-given consent to us at any time. This results in us no longer continuing the data processing based on this consent for the future.

Insofar as personal data is processed on the basis of legitimate interests according to Article 6 paragraph 1 sentence 1 letter f GDPR, you have the right according to Article 21 GDPR to object to the processing of personal data concerning you, provided there are reasons arising from your particular situation. 5. Payment service providers
For payment processing, we use, among others, the Stripe service, provided by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). Stripe processes the following data that you provide as part of the payment: name, email address, billing address, payment data (e.g., credit card or bank account information), order number, transaction amount, date and time of transaction.

Stripe acts as an independent controller for payment processing, whereby we have concluded a data processing agreement (AVV) with Stripe for processing in connection with our platform. Data transmission to the USA (Stripe Inc.) is based on the EU-US Data Privacy Framework (https://www.dataprivacyframework.gov).

This usually includes your name, your payment data (e.g., credit card or account data), the order number and the transaction amount as well as possibly additional information such as transaction IDs or device data, depending on the provider. For data processing in the context of payment processing, the respective payment service provider is the responsible entity.

The legal basis is Article 6 paragraph 1 subparagraph 1 letter b GDPR (pre-contractual measures, contract performance) as well as 6 paragraph 1 subparagraph 1 letter f and c GDPR (legitimate interest and legal proof obligations). We fulfill a contract with you and have the legitimate interest, through the payment functionalities, to be able to offer you effective, widespread and secure payment options and modern online shop functionality, Article 6 paragraph 1 subparagraph 1 letter f GDPR.

We ourselves receive information so that we can capture, confirm and execute your requests through our platform, see above. For example, we do not have access to complete card data but only see the last four digits.

III. Recipients of personal data and third country transfers
Personal data is disclosed to the following categories of recipients:

We process personal data furthermore in a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)) when this is necessary to fulfill our (pre-)contractual obligations, based on your consent, due to a legal obligation or based on our legitimate interests. The same applies to processing by third parties on our behalf, disclosure of personal data to third parties as well as their transmission to third parties. Service providers who process personal data on our behalf in a third country are only used when there is an "adequacy decision" of the European Commission (Article 45 GDPR), "appropriate safeguards" (Article 46 GDPR), "standard data protection contractual clauses" (Article 46 paragraph 2 letter c GDPR) are agreed and/or "internal data protection rules" (Article 47 GDPR) exist at the recipient. IV. Storage duration
We delete personal data after achieving the purpose and cessation of the legal basis as well as in the absence of a retention obligation.

Stored server log files and IP addresses are automatically deleted by our host after 7 days.

Session cookies are also automatically deleted after the session ends. In addition, cookies with an expiration date are stored on your end device, and you also have control over the use and deletion of cookies, see above.

We process personal data from your inquiries via email, contact form or inquiries in another way until your inquiry is completely processed and completed. After that, the data is deleted if there is no legal retention obligation, for example, also data protection proof and documentation obligations according to Article 5 paragraph 2 GDPR or Article 6 paragraph 1 subparagraph 1 letter c GDPR. Please note that due to a legal transaction with you, commercial and tax retention obligations of at least six (§ 257 HGB) or ten (§ 147 AO) years may exist for certain data, which may also apply to the content of contact inquiries and emails. Thus, for example, personal data collected by us after the end of a contractual relationship is generally stored until the expiration of the legal three-year statute of limitations (§ 195 BGB) (safeguarding legitimate interests: defense and enforcement of claims, Article 6 paragraph 1 subparagraph 1 letter f GDPR).

Data from orders in the online shop (e.g., billing data, personalized content) is stored according to legal retention obligations (§ 257 HGB, § 147 AO) for six to ten years and then deleted if there is no other legal basis (e.g., consent).

Furthermore – also regarding all tools used and the above – it is checked annually whether data deletion can occur. This is the case when the processing purpose and the requirements of the legal basis for processing have ceased and there is no longer a legal retention obligation, there is no legitimate interest for defense and enforcement of claims, Article 6 paragraph 1 subparagraph 1 letter f GDPR, and you have also not consented to storage beyond this according to Article 6 paragraph 1 subparagraph 1 letter a GDPR.

V. Provision of personal data and rights of data subjects
You are not legally obligated to provide personal data. However, provision may be necessary for contract conclusion or website functions. In case of non-provision, therefore, possibly a contract or a function on the website cannot be offered.

There is no automated decision-making on the website; profiling does not take place on our website.

The rights of data subjects result in particular from Articles 15 to 23 and Article 77 GDPR as well as from §§ 32 to 37 Federal Data Protection Act.

VI. Information about right to object according to Article 21 GDPR
1. You have the right, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you that is carried out based on Article 6 paragraph 1 subparagraph 1 letter f GDPR (data processing based on balancing of interests).

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

2. If personal data is processed to conduct direct marketing, you have the right to object at any time to the processing of data concerning you for the purpose of such advertising. If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.

The objection can be made without formalities and should preferably be directed to us, see above under I.
